1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Luna Mobility, concerning your access to and use of our mobility technology platform and city parking management systems. By accessing our services, including our pricing calculators and traffic flow algorithms, you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, then you are expressly prohibited from using the services and must discontinue use immediately.
2. Intellectual Property and Permitted Use
Unless otherwise indicated, the services and all source code, databases, functionality, software, and website designs are our proprietary property. You are granted a limited, non-exclusive license to access and use the services solely for authorized municipal management or approved commercial mobility purposes, provided you comply with all security protocols and legal requirements.
- You may not systematically retrieve data or other content from our parking systems to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from Luna Mobility.
- You may not circumvent, disable, or otherwise interfere with security-related features of the service, including those that prevent or restrict the use or copying of our proprietary pricing algorithms and revenue optimization tools.
- You may not use our mobility technology for any unauthorized commercial endeavor, to manipulate municipal revenue data, or to gain an unfair competitive advantage in municipal bidding processes.
3. Disclaimer and Limitation of Liability
The service is provided on an AS-IS and AS-AVAILABLE basis. Luna Mobility disclaims all warranties, express or implied, in connection with the service and your use thereof. We shall not be liable for any damages of any kind arising from the use of our pricing calculators or traffic management systems, including but not limited to direct, indirect, incidental, punitive, and consequential damages, even if advised of the possibility of such losses.
4. Governing Law, Modifications, and Contact Information
These Terms and Conditions and your use of the service are governed by and construed in accordance with the laws of the jurisdiction in which Luna Mobility operates, without regard to its conflict of law principles. Any legal action of whatever nature shall be brought exclusively in the courts of said jurisdiction.
We reserve the right to change or modify these Terms at any time. We will alert you about any changes by updating the 'Effective Date' of these Terms. Your continued use of the service after such changes constitutes your acceptance of the new Terms.
